Keeping Families Together – What is Happing Now?

Writer: Bennett & HarkerBennett & Harker

In June, President Biden announced a new program allowing certain undocumented spouses of U.S. citizens to request parole and remain in the U.S. legally while they apply for permanent residency, rather than having to leave the U.S. to have their cases processed.

Recently, 16 states challenged the program in court. On Monday of this week, a court in Texas issued a temporary restraining order, putting the program on hold for at least the next couple of weeks. For now, this means that U.S. Citizenship and Immigration Services will continue to accept applications for the Keeping Families Together program but will not review or make a decision on any of those applications until the temporary restraining order is lifted.

If you believe you or your spouse might qualify for benefits under this new program, we recommend applying as soon as possible in case the court takes further action to limit, or even eliminate, benefits under the Keeping Families Together program. If you’d like to schedule a consultation to learn more about the program and the benefits of applying sooner rather than later, please contact us!
