Starting on June 5, 2024, new limitations on requests for asylum at the U.S.-Mexico border went into effect. The restrictions, put in place by the Biden administration, will make it increasingly difficult for immigrants to seek asylum in the U.S. and will remain in effect until the number of immigrants apprehended at the border falls and remains below 1500 for seven days.

Under the new policy, immigrants who are caught attempting to enter the U.S. between immigration check points will be removed from the United States, even if they express fear of harm in their home country. These immigrants will not be give the opportunity to apply for asylum in the U.S. except under very limited circumstances.

The ban will not apply to people who use the CBP One cell phone application or who otherwise are able to secure an appointment to request asylum at a U.S. border crossing checkpoint along the U.S.-Mexico border. It will also not apply to unaccompanied minors, people who face serious medical or safety threats, and victims of trafficking.

If you or a family member are outside of the U.S. and are interested in applying for asylum, the attorneys at Bennett & Harker can provide guidance on how to protect your asylum claim and enter the U.S. safely. Please contact us for help!
