A couple is required to prove they have a “bona fide relationship” for an immigrant to obtain a green card via a marriage to a Lawful Permanent Resident or U.S. citizen. A bona fide marriage means a legitimate marriage, rather than a marriage that was entered into solely for gaining an immigration benefit.
To prove your marriage is bona fide, the first step is to include a copy of your marriage certificate along with your application. However, a marriage certificate on its own will not be enough evidence to establish that the marriage is bona fide. USCIS is looking for additional evidence that the couple is in a real relationship and are building a life together.
Here’s a brief list of documents you can provide to help establish a bona fide marriage:
1. Documentary Evidence:
a. Copies of birth certificates of any shared children.
b. Financial documents that show you have combined your assets/liabilities such as proof of joint bank accounts, tax returns, utility bills, or credit cards.
c. A joint mortgage or lease agreement to show that you live together or have lived together in the past.
2. Photographic Evidence: photos that depict your life together, including wedding photos, family gatherings, vacations, and everyday moments. These visual representations can help paint a picture of your shared experiences.
3. Affidavits from Family and Friends: statements from relatives, friends, or colleagues who can attest to the validity of your marriage can strengthen your case. These affidavits should detail how long they’ve know you as a couple and provide specific examples of your relationship.
4. Communication Records: copies of emails, text messages, and letters exchanged between you and your spouse can demonstrate ongoing communication and emotional support, further proving the authenticity of your marriage.
There are no black and white rules regarding the proof required to establish a bona fide relationship and the above list provides some examples but is not exhaustive.
