What is a T visa?

The T visa is a temporary visa available to certain individuals who have been victims of human trafficking inside the United States. To be eligible for the T visa, an immigrant must show that they’ve been a victim or labor or sex trafficking, are present in the U.S. on account of the trafficking, that you cooperated with law enforcement in the investigation or prosecution of the trafficking, and that you would suffer extreme hardship if you were removed from the U.S.


Immigrants who have been forced to work with little to no pay, as well as immigrants who have been forced to engage in commercial sex acts may qualify for the T visa. Eligible immigrants receive a temporary visa that is valid for four years, as well as work authorization. After three years in T visa status, or when the immigrant is able to obtain a letter from the U.S. Department of Justice stating that their case is no longer being investigated, a T visa holder can apply for lawful permanent residency in the U.S., and after five years as a permanent resident, individuals can also pursue U.S. Citizenship.
